Terms of Service

These Terms of Service constitute a legally binding agreement between you and Tired Events, Inc. governing your use of the Tired Events platform. Please read them carefully before creating an account or using any of our services.

1. Acceptance of Terms

By accessing or using the Tired Events platform (the "Platform") at tired.events or any associated mobile application, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific features or services.

If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not use the Platform.

Tired Events, Inc. ("Tired Events", "we", "us", "our") reserves the right to modify these Terms at any time. We will provide 14 days' notice before material changes take effect. Continued use after that date constitutes acceptance.

2. Description of Services

Tired Events provides an online marketplace that connects event organizers with service providers and attendees. Our Platform enables users to:

  • Create, publish, and manage event listings
  • Sell and purchase event tickets
  • List and book event-related services (DJs, photographers, caterers, etc.)
  • Communicate between organizers, service providers, and attendees
  • Process payments for tickets and services

Tired Events is a marketplace and is not responsible for the conduct, content, or outcomes of events hosted by third-party organizers, or for the quality of services provided by listed service providers.

3. User Accounts

To access most features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your authentication credentials secure and confidential
  • Notify us immediately of any unauthorized account access at security@tired.events
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age to create an account. Accounts may not be transferred or sold without prior written consent from Tired Events.

4. Payments & Fees

All payments on the Platform are processed by Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

tired. charges a buyer service fee of 6% + $0.50 per order, capped at $12.00 maximum. Organizers pay 0% platform fees — they receive 100% of face value. Platform fees are non-refundable except where an event is cancelled by the organizer.

Refunds for ticket purchases are subject to the individual event organizer's refund policy, which must be displayed on the event page. Tired Events is not obligated to issue refunds on behalf of organizers. All ticket sales are final unless the organizer has expressly enabled a refund window.

In the event of an event cancellation by the organizer, Tired Events will facilitate a full refund of the ticket price (excluding platform fees) to attendees within 5-10 business days.

4a. Chargebacks & Disputes

Before initiating a chargeback or payment dispute with your card issuer or bank, you must first contact Tired Events support at help@tiredapi.co and allow 5 business days for resolution. Initiating a chargeback without first contacting support, or filing a fraudulent or bad-faith chargeback, will result in immediate permanent account ban and may be referred to a collections agency for any resulting fees. Tired Events reserves the right to contest all chargebacks we deem fraudulent.

4b. Free Trial Policy

Promotional free trials are limited to one per payment card, ever. Cards are fingerprinted by our payment processor. To validate a card for trial eligibility, a $1.00 authorization hold is placed and immediately voided — no charge is made. Using multiple cards, prepaid cards, or virtual card numbers to circumvent the one-trial-per-card limit is a violation of these Terms and may result in account suspension.

5. Event Organizer Responsibilities

Tired Events is a marketplace and technology platform only. We are not the organizer, producer, promoter, or operator of any event listed on the Platform. Organizers are solely and exclusively responsible for delivering their events as described, all refund decisions, compliance with applicable laws and permits, and payment of all applicable taxes.

If you create and publish events on the Platform, you agree to:

  • Provide accurate, complete, and non-misleading event information
  • Obtain all necessary permits, licenses, and insurance for your event
  • Comply with all applicable local, state, and federal laws and regulations
  • Honor tickets and ticket-holder rights as advertised
  • Notify attendees and Tired Events promptly in the event of changes or cancellation
  • Not use the Platform to collect payments for events you do not intend to host
  • Bear sole liability for any claims, damages, or losses arising from your event

Tired Events bears no liability for event cancellations, postponements, poor event quality, venue issues, performer no-shows, or any other matters within the organizer's control.

6. Vendor Conduct

If you list services on the Platform as a vendor or service provider, you agree to:

  • Accurately represent your qualifications, experience, and service offerings
  • Hold all licenses, permits, and insurance required for your service type and jurisdiction
  • Deliver services as described and agreed upon with organizers
  • Maintain professional conduct in all communications on the Platform
  • Not engage in price manipulation, fake reviews, or other deceptive practices

Tired Events reserves the right to remove listings, revoke Verified status, or suspend accounts that violate these responsibilities.

7. Intellectual Property

The Tired Events Platform, including its design, code, trademarks, and original content, is owned by Tired Events, Inc. and protected by copyright, trademark, and other intellectual property laws.

By uploading content to the Platform (event photos, portfolio images, event descriptions, etc.), you grant Tired Events a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for the purposes of operating and promoting the Platform.

You represent that you own or have the right to use all content you upload, and that doing so does not infringe any third-party rights.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or to promote illegal activities
  • Harass, threaten, or harm other users
  • Post false, misleading, or defamatory content
  • Attempt to circumvent platform fees or payment systems
  • Scrape, crawl, or otherwise extract data from the Platform without written consent
  • Attempt to gain unauthorized access to any part of the Platform or other users' accounts
  • Use bots or automated tools to interact with the Platform without our express permission
  • Resell or transfer access to your account

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TIRED EVENTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, Tired Events's liability shall be limited to the maximum extent permitted by law.

In no event shall Tired Events's total cumulative liability to you exceed the greater of (a) $100 USD or (b) the total amount you paid to Tired Events in the twelve months preceding the claim.

10. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Platform shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement claims.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York.
